Similarly, these 3 criminal laws in India. They are like the 3 big structure of India, which impacts every Indian. But in the last 100 years, the nature of crimes, the method of crime and criminals, all of them have changed drastically. And to be honest 100 years ago, how could anyone have thought that there would be a crime called cybercrime Thats why the parliament has decided to replace these 3 laws with these 3 new criminal laws. Which we are going to criticize and analyze also . At first we are discussing what is the objective of the government in bringing these laws?. The problem that was existing in the system earlier and has it been solved by bringing the new laws or not?. Now, there are many parameters to judge whether any criminal law is good or not. But according to me in the end point comes to three things.
- Firstly is there timely justice
- Did the accused get a fair trial
- Did the victim get a fair compensation.
There are 3 good things to presumed that knowledge, uniformity and certainty. For example a 16-17 year old kid takes his car without a helmet and he caught so he cannot please that he did not know that there is such a law. Ignorance of law is not an excuse. The act is written so that knowledge can be obtained properly it’s a example of knowledge. Now we will discuss what is the problem with these existing laws ,So British period there are four law commissions were set up, to make laws on different subjects. No.1 the first law commission had Thomas Babington Macaulay and 3 other members, who made some important laws for India. There after 2nd 3rd 4th law commission were also made who by looked at Indian conditions. And also made some important laws in the next 50 years. Their contribution were so important that even today’s date , the very important laws of India like contract Act, Transfer of property Act, Civil procedure code , Indian penal code are also their contribution.
Now let’s come to our orginal question that what is the problem with the existing laws. First of all, the objective of making them was to exploit the resources of india, and stop any type of revolt from happening.Along with this in the parliament,Amit Shah said that in these laws,there are still in more than 400 places the British crown is mentioned. Which even after 75 years of independence shows the Colonial Slavery. They have complicated structures etc. And all these problems have been addressed in New Laws.
Now come to the main point that what is new in these new laws. So to replace Indian penal code, Bharatiya Nyaya Sanhitahas been proposed. In old Act, there were a total of 576 sections, which are now only 356 in the new Act. It has to modify around 175 sections and also 22 sections has been told to removed. The added provisions are sec 69, 70(B),93,101(2), 104(2),109,110,111,115(3),150,224,302.
After this , instead of the code of criminal procedure is changed to Bharatiya Nagarik Suraksha Sanhita has been proposed. Old provision is 484 sections now it’s 533 sections. There are 9 new provisions have been added here. After this , instead of Indian evidence act has 167 section, now it has changed 170 sections.
